AcousPlan is an acoustic design tool for informational purposes. Payments handled by Paddle. Results are advisory — verify with a professional. You own your project data.
1. Acceptance of Terms
By accessing or using AcousPlan (acousplan.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including free-tier visitors.
2. Service Description
AcousPlan is a cloud-based acoustic design and simulation platform providing RT60 calculations, STI estimates, material analysis, compliance checking against international standards, and AI-powered recommendations. Results are for informational and preliminary design purposes only.
3. Account Registration
Certain features require registration. You must be at least 16 years old. You are responsible for maintaining account credential confidentiality and for all activities under your account.
4. Service Tiers
AcousPlan offers Free (limited features, watermarked reports), Professional (expanded features), and Team (collaboration, API access) tiers. We may modify tier features with 30 days' notice. Current pricing at acousplan.com/pricing.
5. Payments and Billing
Payments are processed by Paddle.com as Merchant of Record. By subscribing, you agree to Paddle's Terms of Use (paddle.com/legal/terms). Paddle handles invoicing, tax collection, and refund disbursement. For billing inquiries contact Paddle; for feature access contact [email protected].
6. Intellectual Property
The AcousPlan platform, source code, algorithms, and branding are owned by AcousPlan and protected by intellectual property laws. Material database data is sourced from manufacturers' published specifications.
7. Your Content and Data
You retain ownership of your project data, room configurations, and simulation results. We process and store your content solely to provide the Service. We do not sell or share your content. Upon termination, data is available for export for 30 days.
8. Acceptable Use
You agree not to: reverse engineer the simulation engine; scrape the material database; redistribute database content in bulk; use automated tools without an API subscription; impersonate others; or use the Service unlawfully.
9. AI Features Disclaimer
AI features (Snap & Solve, AI Prescription, Chatbot) use third-party LLM APIs. AI outputs may contain inaccuracies. Recommendations are suggestions only, not professional engineering advice. Verify AI suggestions with a qualified consultant.
10. Simulation Accuracy Disclaimer
Simulations use Sabine, Eyring, and ray-tracing models that approximate real-world acoustics. Actual performance will differ due to construction tolerances, materials, furniture, HVAC noise, etc. Do not rely solely on simulations for building code submissions or safety-critical decisions. Engage a qualified professional for verification.
11. Third-Party Services
The Service integrates with Paddle (payments), Anthropic Claude API (AI), Cloudflare (CDN/security), Plausible Analytics (cookieless analytics), and Resend (email). Each is governed by its own terms.
12. Limitation of Liability
To the maximum extent permitted by law, AcousPlan shall not be liable for indirect, incidental, special, or consequential damages. Total liability shall not exceed amounts paid in the preceding 12 months, or SGD 100 for free-tier users.
13. Indemnification
You agree to indemnify AcousPlan from claims arising from: your use of the Service; reliance on results without professional verification; violation of these Terms; or violation of applicable law.
14. Termination
Either party may terminate at any time. Cancel via account settings or [email protected]. Upon termination, paid features cease at billing period end. Data available for export for 30 days.
15. Changes to Terms
We may update these Terms with 30 days' notice for material changes. Continued use after changes constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the Republic of Singapore. Disputes are subject to the exclusive jurisdiction of Singapore courts. EU users retain statutory consumer rights.
